Terms of Use

Last updated: 18 October 2026

These Terms of Use ("Terms") apply to the Markup Studio platform, the websites hosted on it and all related services (the "Services"), offered by Markup Studio, a sole proprietorship of Mark Saado in the Netherlands (KVK 99547171) ("we", "us"). By creating an account or using the Services you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old, or have the legal capacity to enter into a contract, to create an account. If you use the Services for a company, you confirm that you may bind that company to these Terms.

2. Your account

  • Give accurate details and keep them up to date.
  • Keep your password secret; you are responsible for activity under your account.
  • Tell us immediately at info@markupstudio.app if you suspect unauthorised use.

3. Trial, subscriptions and payment

  • A new website starts with a free trial with limited features and capacity. To keep it online after the trial, start a subscription.
  • Subscriptions are per website and billed monthly in advance through Stripe. Optional add-ons (such as extra AI prompts, storage or video streaming) are billed the same way. Current prices are shown on our website and in the dashboard.
  • Subscriptions renew automatically. You can cancel at any time; the cancellation takes effect at the end of the current billing period, and you keep access until then.
  • Payments already made are not refunded, except where the law requires it.
  • If you are a consumer in the EU, you have a 14-day right of withdrawal. By starting a subscription you ask us to start the service right away, and if you withdraw you pay for the part already provided.
  • We may change prices with at least 30 days' notice by email. The new price applies from your next billing period; if you do not agree, you can cancel before it starts.

4. Plan limits

Each plan includes limits, for example storage, monthly AI prompts and a monthly video streaming budget. When a limit is reached, the related feature pauses until the next period or until you add capacity — for example, videos show their poster image once the streaming budget is used up, while the rest of the website stays online.

5. Domains

Every website gets a free subdomain of markupstudio.app; the subdomain remains ours and may be released when the website is deleted. You can connect your own domain: you are responsible for registering, renewing and configuring it.

6. Acceptable use

You may not use the Services to:

  • publish illegal, hateful, violent or sexually explicit content, or content that harms minors;
  • infringe intellectual property, privacy or other rights of others;
  • impersonate others, phish, or collect passwords or payment data under false pretences;
  • send spam, distribute malware, or attack or overload our systems or anyone else's;
  • collect or process personal data in breach of data protection law.

7. Your content

You keep all rights to the content you add. You give us a limited licence to store, copy, adapt (for example resize images) and display it, only to provide the Services. You confirm you have the rights needed for everything you upload.

We may remove content or suspend a website when we receive a well-founded notice that it is unlawful or breaks these Terms. Where possible we tell you first and give you the chance to respond.

The platform itself — its software, design, templates and brand — belongs to us. You may use templates and ready-made blocks on your websites built with the Services.

8. Your visitors' data (data processing)

For the personal data of your website's visitors (such as form messages and statistics) you are the controller and we are your processor. This section is our data processing agreement under Article 28 GDPR:

  • We process visitor data only to provide the Services and on your documented instructions — your settings in the dashboard.
  • Everyone at Markup Studio who has access to the data is bound to confidentiality.
  • We take appropriate security measures, including HTTPS, encryption of form messages and limited access.
  • You authorise the sub-processors listed in our Privacy Policy. We will inform you of changes in advance, and you may object.
  • We help you respond to visitors' requests to exercise their rights, for example by letting you export and delete messages.
  • We inform you without undue delay after becoming aware of a personal data breach affecting your website.
  • When your website or account ends, we delete the visitor data within 30 days, unless the law requires otherwise.
  • On request we provide the information needed to show compliance with this section.

9. Your responsibilities as a website owner

You are responsible for your website's content and for meeting the laws that apply to your business. The automatic privacy page and the cookie banner are tools to help you; they are not legal advice. If you add trackers (such as analytics or advertising pixels), you are responsible for using them lawfully.

10. AI features

AI-generated texts and layouts may be inaccurate or unsuitable. Check them before publishing; you are responsible for what you publish. Do not enter sensitive personal data in AI prompts. AI features are provided through third-party providers listed in our Privacy Policy.

11. Availability and changes to the Services

We work to keep the Services available and fast, but we cannot guarantee uninterrupted service; maintenance and incidents can happen. We may improve, change or stop features. If we stop a feature you pay for, we will tell you in advance.

12. Suspension and termination

  • You can stop using the Services and cancel your subscriptions at any time.
  • We may suspend a website when a payment fails, the trial ends without a subscription, or these Terms are broken. Serious or repeated violations may lead to closing your account.
  • Suspended websites and their data may be deleted after a reasonable period; we will notify you by email before deleting.

13. Liability

The Services are provided "as is". To the extent permitted by law, we are not liable for indirect or consequential damage, such as lost profit or lost data, and our total liability is limited to the fees you paid us in the 12 months before the event. These limits do not apply to damage caused by our intent or gross negligence, or where the law does not allow them. If you are a consumer, your mandatory legal rights remain unaffected.

You are liable for claims by third parties that result from your content or from your breach of these Terms.

14. Changes to these Terms

We may update these Terms. We will email account holders about important changes at least 30 days before they take effect. If you do not agree, you can cancel before the new Terms apply; continuing to use the Services means you accept them.

15. Governing law and disputes

These Terms are governed by Dutch law. Disputes are brought before the competent court in the Netherlands. If you are a consumer, you may also rely on the protection and courts of the country where you live.
